CCMS filed suit against Apple concerning battery issues and Apple’s decision to “throttle” (or reduce the performance ability of) older iPhones. These issues caused iPhones to fail prematurely, leaving customers with the unenviable choice of either purchasing a new, expensive phone or continuing using a phone that would lose power without notice and perform worse than promised. The case—In re: Apple Inc. Device Performance Litigation, Case No. 18-md-02827—is being litigated in the Northern District of California, and CCMS has been appointed Co-Chair for the Damages/Settlement Committee.
