Daniel O. Herrera

A first-generation Cuban-American, Daniel O. Herrera brings a collaborative and adaptable approach to his practice and values close partnerships with co-counsel. Since beginning his legal career at Mayer Brown LLP, Mr. Herrera has spent more than fifteen years representing clients in complex class actions in federal and state courts across the country.

An accomplished antitrust litigator, Mr. Herrera developed his experience in significant matters including In re FOREX, No. 13-cv-7789 (S.D.N.Y.), In re Disposable Contact Lens Antitrust Litigation, MDL No. 2626 (M.D. Fla.), and In re Automotive Parts Antitrust Litigation, MDL No. 2311 (E.D. Mich.). In recent years, he has played a leading role in the firm’s groundbreaking multidistrict antitrust class actions challenging longstanding anticompetitive practices in two of the nation’s largest industries. Mr. Herrera serves on the Steering Committee in In re Apartment Rental Software Antitrust Litigation, No. 23-md-3071 (M.D. Tenn.), involving allegations that the defendants conspired to inflate residential rental prices in major geographic markets nationwide. Plaintiffs have secured more than $200 million in settlements to date. He also serves as co-lead counsel for a class of ranchers in In re Cattle and Beef Antitrust Litigation, No. 22-md-03031 (D. Minn.), where the court recently certified a damages class and plaintiffs already have secured an $83.5 million settlement from one of four defendants.

 Mr. Herrera also leads the firm’s consumer litigation practice and has helped secure hundreds of millions of dollars in relief in product liability, privacy, and data breach litigation. His representative matters include: Balfour v. iFIT Health and Fitness, Inc., No. 23-cv-67-CFC (D. Del.) (Co-lead counsel in an action securing refunds and repair services for owners of defective fitness equipment); In re Behr DeckOver Marketing, Sales Practices, and Products Liability Litigation, No. 17-cv-4464 (N.D. Ill.) (Co-lead counsel in a settlement recovering 75% of documented repair costs); Sharp v. Watts Regulator Co., No. 8:16CV200 (D. Neb.) (Co-lead counsel alleging property damage that resulted in $28 million in combined settlements); and Murphy v. Kochava, No. 23-cv-00058 (D. Idaho) (Co-lead counsel in an action that imposed significant restrictions on a data broker’s collection, aggregation, and sale of sensitive consumer information, including geolocation data).

Outside of work, he enjoys spending time with his wife and two children and volunteering with Beat the Streets Chicago, a charitable organization that enriches the lives of young people through wrestling.

Mr. Herrera received his law degree, magna cum laude, and his MBA, with a concentration in finance, from the University of Illinois at Urbana-Champaign in 2008, and his bachelor’s degree in economics from Northwestern University in 2004.
